Bruce Tanski Disgraces Himself

Bruce Tanski wants to build a cheesy apartment complex, one like other cheesy apartment complexes he has built. Bruce Rischert didn't want another one in his town. Mr. Tanski's complexes don't have the best reputations. Mr. Rischert thought the proof was in the lousy reviews and lawsuits. Mr. Rischert spoke up about Mr. Tanski at town meetings against the proposed apartments.

Rather than defend himself, Mr. Tanski agreed that his apartments are cheap ass. He didn't claim he learned from his mistakes. He didn't say he decided it would be a sense of pride to build quality apartments or treat his disabled tenants fairly. No, none of those. Mr. Tanski slapped Mr. Rischert with a $2.5 million libel and slander lawsuit, stating "disgrace, humiliation and shame throughout the community, permanent harm to his professional and personal reputations, and severe mental anguish and emotional distress." Mr. Tanski is even cheesier than his apartments. We have the right to say we think he builds crap. We have the right to repeat bad things people that have rented from him have said. Residents have a reason to be concerned about a man who was charged by the Justice Department for his practices. Suing a man for speaking his mind is low, especially when Mr. Tanski has nothing constructive with which to defend himself.

After 40 years maybe it is time to retire, Mr. Tanski. And drop the lawsuit. It is doubtful you will win. Continuing to be a bully just makes you a bigger asshole. Please just go away because you are the disgrace.

Wow, suing someone over an opinion voiced in a public forum. That's a Dickhead with a capital 'D'. I hope the town defends Mr. Rischert since a town sponsored meeting shouldn't scare residents away with fear of being slapped with a lawsuit if they object.

Regardless, Tanski is a douche, if people didn't know it before they do now. Hopefully the town will tell him to go build his shit-holes elsewhere.

he has alwaysssssssssssssssss been a idiot,u stand up to him he backs right down,i dealt with him in the late 80s doin automotive work for him,hes a sleezeball and a crook,his rep was shot a long time ago,he thinks the sheriffs and state troopers love him,they dont,and whats goin on with his halfmoon donations?something phoony there for sure

Three days before Christmas, on December 22, I was served with a 2.5 million dollar libel and defamation lawsuit regarding a letter I wrote and read at a public hearing to the Town Board of Halfmoon in opposition of Bruce Tanski's planned development, Anna's Place. I was given 20 days to find an attorney and respond to the complaint. The burden of finding an attorney that specializes in this field was exacerbated by the holiday season and it forced me to remove myself from public participation involving the Anna's Place project, as it was revised and filed with the town 1 week later on December 29. Coincidence or planned? Hmmmmm……..

Mr. Michael Grygiel of Traurig and Greenberg (http://www.gtlaw.com/People/GrygielMichaelJ ) was retained in early January. A response to the court was filed and correspondence was sent to Tanski's attorney, Richard C. Miller (http://www.rcmillerjrlaw.com/), outlining how we were going to respond. Basically the letter stated how he will lose the lawsuit and that he will have to pay attorney fees. We asked that they drop the lawsuit on the grounds that were outlined, without any cost to them. We gave them substantial time to respond. A deadline was set that if they did not respond by, would forced us to move forward with a motion to the court for dismissal. The deadline in February came and went without any correspondence from Mr. Miller. The week we were to file, my attorney received a phone call from Mr. Miller. Interestingly it was the same night the town of Halfmoon held its public hearring for Tanski's proposed Anna's Place. Miller told my attorney that they wanted to drop the lawsuit but that there be a confidentiality clause. The clause would prevent me from speaking about the case. My attorney immediately called me with this information and responded to Miller that we are interested and willing to discuss terms. Mr. Miller asked for a 30 day extension. This was granted to him. Within that 30 day period there were no other correspondence from Tanski's attorney, Mr. Miller. This waiting period was once again perfect timing for Tanski's Anna's Place project as it came up in front of the town of Halfmoon Planning Board for a vote on March 11, 2013, this was the monday before the noon friday deadline Miller agreed to. It was approved by the board that monday night. Mr. Michael Grygiel, my attorney, sent Mr. Miller the motion papers tuesday March 12 that were to be filed on that friday, the agreed upon deadline. We were hoping that we would be able to settle this. Mr. Miller never responded to Mr. Grygiel. He had not called, written a letter or e-mail. Nothing within the 30 day extension granted to him. Developers use SLAPP suits to suppress opposition to their projects. Most know they will lose and figure that into their cost of the project. Tanski was successful in this. He kept me quiet and intimidated some others from talking.

So, to sum it up- Tanski filed a SLAPP lawsuit against an outspoken critic to his Anna's Place project then filed a revised plan for Anna's Place a couple of days later to the town of Halfmoon. It quickly went before the board. Miller asked for a 30 day extension to discuss settling the case the same night of a public hearing in regards to Anna's Place. That effectively kept me quiet. Then 30 days after the public hearing the Planning Board voted on it and passed it, all within the agreed upon extension that expired at the end of the week. We we forced to file the motion for dismissal on Friday afternoon. This now rests in the hands of the court. If Tanski and Miller were truly interested in dropping the case one would think some sort of correspondence would be had. In my opinion this was a tactical move to get what they want. Me quiet and the project passed, success.

But, now the table may have turned for Mr Tanski. In my opinion his craftiness, obstinance and ego has put him in a bad position with the court. Does he think a judge or anyone can't see what he did? The judge has the power to dismiss the lawsuit and discretion to grant attorney fees, costs, damages and other sanctions the court deems just and fair. I believe I will be vindicated in both the judicial court and the court of public opinion.

The board should hang it's head in shame. They KNEW that tax paying residents of their community had concerns and they approved the scumbag Tanski's crappy development.
